Welcome to elpinerofilm.com (the “Site”), the website for the short film El Pinero. The Site is operated by Far Shore Media, LLC, a Florida limited liability company (“Far Shore Media,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms of Service (“Terms”). If you don’t agree, please don’t use the Site.

1. About the Site

The Site provides information about El Pinero, a short film written and produced by Robert Potter and directed and co-produced by Meilín Quilez Durañona, including updates on the project, ways to support it, and general information about the people involved.

2. Use of the Site

You may view and use the Site for personal, non-commercial purposes. You agree not to:

  • Copy, reproduce, republish, or redistribute any substantial part of the Site’s content without our prior written permission
  • Use any automated system (bot, scraper, etc.) to access the Site in a way that sends more requests than a human could reasonably produce
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems
  • Use the Site for any unlawful purpose

3. Intellectual Property

Unless otherwise noted, all text, images, video, stills, designs, and other content on this Site are owned by Far Shore Media, LLC or used with permission, and are protected by U.S. and international copyright and trademark law. “El Pinero” and any associated logos or marks are the property of Far Shore Media, LLC. Nothing on this Site grants you any license or right to use our content or marks except as expressly stated here.

4. Casting and Audition Submissions

If you submit audition materials, a self-tape, or related information through this Site or in response to a casting call we’ve posted:

  • You represent that you have the right to submit that material, and that it doesn’t infringe anyone else’s rights.
  • You grant Far Shore Media, LLC and our production team (including our director, Meilín Quilez Durañona) permission to review, store, and share your submission internally for the purpose of evaluating you for the role.
  • Submitting an audition does not guarantee a role, a response, or that your materials will be retained beyond the casting process.

5. Donations and Our Fiscal Sponsor

El Pinero is a fiscally sponsored project of From the Heart Productions, a 501(c)(3) nonprofit organization. When you donate through the “Donate” link on this Site:

  • Your donation is made to, and processed by, From the Heart Productions through PayPal — not directly to Far Shore Media, LLC.
  • Donations are tax-deductible to the extent allowed by law; we recommend keeping your own donation receipt for tax purposes.
  • Donations are voluntary and generally non-refundable, except as required by law or at the discretion of From the Heart Productions.
  • Donor-tier items (such as sticker sets or care packages) are fulfilled on a best-efforts, first-come, first-served basis, are subject to availability, and may take time to arrive given that the film is still in production. We’ll do our best to keep timelines realistic and communicate delays.
  • The use, administration, and final disposition of donated funds are subject to the terms of our fiscal sponsorship arrangement with From the Heart Productions.

The Site links to or embeds content from third-party platforms, including PayPal, Kit, YouTube, Instagram, Facebook, and TikTok. We don’t control these third parties, and your use of them is governed by their own terms and privacy policies, not ours. We’re not responsible for their content, availability, or practices.

7. No Warranty

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. We don’t guarantee that the Site will be error-free, uninterrupted, or available at all times. We also don’t guarantee any particular outcome for the film El Pinero itself, including its completion, funding, festival acceptance, distribution, or release date.

8. Limitation of Liability

To the fullest extent permitted by law, Far Shore Media, LLC and its members, managers, and collaborators won’t be liable for any indirect, incidental, special, or consequential damages arising out of your use of, or inability to use, the Site — even if we’ve been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold Far Shore Media, LLC harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be subject to the non-exclusive jurisdiction of the state and federal courts located in Florida.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted means you accept the updated Terms. We’ll update the “Last updated” date above whenever we make changes.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
